Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kashflyer performance-marketing tracking platform and related websites (the “Platform”), provided by KashFlyer (“Kashflyer”, “we”, “us”). By accessing or using the Platform you agree to these Terms. If you use the Platform on behalf of an organization, you represent that you are authorized to bind that organization.

1. The service

Kashflyer provides tools to create offers, distribute tracking links, record clicks and conversions, integrate measurement partners, detect fraud, and calculate payouts. Features, limits, and pricing may be set out in a separate order or plan.

2. Accounts & eligibility

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Enabling two-factor authentication is strongly recommended. Notify us promptly of any unauthorized use.

3. Acceptable use

  • Do not send fraudulent, bot, incentivized-without-disclosure, or otherwise illegitimate traffic;
  • Do not use the Platform for unlawful, deceptive, or infringing activity;
  • Do not attempt to breach, probe, overload, or circumvent security or access controls;
  • Do not misrepresent traffic sources or tamper with tracking or postbacks;
  • Comply with all applicable laws, advertiser terms, and platform policies.

4. Customer responsibilities & data protection

You are responsible for the data you collect and process through the Platform and for providing any notices and obtaining any consents required from your end users. Where Kashflyer processes personal data on your behalf, it does so as your processor in accordance with our Privacy Policy and, where applicable, a data processing agreement.

5. Fees & billing

Fees, usage allowances, and overage charges are as agreed in your plan or order. Unless stated otherwise, fees are non-refundable. We may suspend access for overdue amounts after reasonable notice.

6. Intellectual property

The Platform, including its software, design, and content, is owned by Kashflyer and its licensors. You retain ownership of your data. You grant us the rights needed to operate the Platform and provide the service to you.

7. Third-party services

The Platform can integrate with third-party services (for example, measurement partners and postback endpoints) that you choose to enable. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Kashflyer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability arising out of or relating to the Platform will not exceed the amounts you paid to us in the three months preceding the event giving rise to the claim.

10. Suspension & termination

We may suspend or terminate access for breach of these Terms, suspected fraud, legal risk, or non-payment. You may stop using the Platform at any time. Provisions that by their nature should survive termination will survive.

11. Changes

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of India, and the courts of India will have jurisdiction over any disputes, without regard to conflict-of-laws principles.
